Copyright
In a case where Heysan provides the ability to upload materials, the following applies in terms of Copyright
Heysan respects the intellectual property of other peoples work and so should you. Heysan acts as a neutral host for the content that you decide to upload and will not control its users.
Heysan takes no responsibility for the material you upload being yours but depend on your promise not to upload anything that you do not own the rights for.
Heysan does not claim any copy right or ownership to, by a user, uploaded material.
Heysan encourage users and independent websites to use the services provided by Heysan with responsibility but can not ensure that some players might be engaged in activities that oppose the intellectual property rights of users.
Material available to you via Heysan might be limited to copyright laws in the USA or other countries. Heysan will not provide you with any specific information for what the copy right laws are in the USA or in any other country but it's up to You to make sure that the way you are treating materials provided to you via Heysan complies with the laws in your jurisdiction.
If Heysan finds that a user is infringing with copyright laws repeatedly, Heysan may take action and delete that user's account without informing the registered user but Heysan do not provide this task as a part of the Heysan services.
If you provide your own personal ideas to Heysan, those ideas immediately becomes the property of Heysan and you will automatically give up your intellectual property rights for those ideas. If you have ideas that you want to share with Heysan but for which you wish not to give up intellectual property rights for, please contact Heysan with only a brief summary of your idea, do not give us any details. In order for Heysan to further evaluate your concepts, a legal agreement will be required.
If you find that a user of the Heysan services are violating the laws for intellectual property or copyright, as soon as possible, please inform Heysan Inc in a written notice including the following documentation:
- A description of the copyrighted work that you consider being at issue and a description of where on the Heysan site the materials can be found.
- Your contact information including the phone number where we can most likely reach you, your home address and email address.
- A written statement signed by you saying that you have a good faith belief that the materials at issue are not authorized by the owner of the intellectual property or the copyright.
- A testified statement signed by you saying that you are the owner of the intellectual property or copyright or that you are authorized to act on the true owner of the intellectual property or copy right.
- After receiving your notice, Heysan will evaluate the situation and decide whether the accused user has actually violated the laws for protection of Intellectual Property and Copyright or not and will, in case we find that your complaint is accurate, terminate the accused users account.
